OFFICIAL RULES
tbt*s LOCAL MUSIC SHOWCASE CONTEST 2008

These rules are for tbt*s Local Music Showcase Contest (“the Contest”), starting Friday, March 21, 2008 at 6 a.m. EST and ending Sunday, May 11, 2008 at 11 p.m. EST. Entry into the Contest constitutes the entrant’s full and unconditional agreement to and acceptance of these rules, terms and conditions.

ELIGIBILITY. NO PURCHASE IS NECESSARY TO ENTER OR WIN. Purchase will not improve chances of winning. The Contest is open to legal residents of the United States and Florida who are 18 years of age or older at the time of entry, except employees of the Times Publishing Company, its affiliates and subsidiaries, advertising and promotion agencies, contest prize suppliers, and participating advertisers and their immediate family members are not eligible to enter or win. “Immediate family members” means parents, siblings, spouses, children, grandparents and grandchildren, whether by current or past marriage, remarriage, adoption or cohabitation, and anyone living in the same household, whether related or not. Times Publishing Company’s determination as to eligibility is final and binding.

HOW TO ENTER Entries may be made via mobile text message. To enter you must vote for your favorite band using the Text 78247 keyword tbt1, tbt2, tbt3, tbt4, tbt5, tbt6, tbt7, tbt8, tbt9 or tbt10. Standard text messaging rates apply. Text entry not supported by Metro PCS or Cricket.

Mobile text entries must be submitted and received between the times stated above. Incomplete text entries are void. Times Publishing Company and its affiliates are not responsible for late, lost, incomplete, misdirected, garbled, jumbled, illegible or ineligible entries or for any computer, online, telephone, cable, network, electronic or Internet hardware or software malfunctions or failures, or any human or technical error that may occur. Every mobile text entrant must be the authorized account holder of the mobile text address submitted at the time of entry. “Authorized account holder” means the person to whom the mobile device is assigned by a mobile provider. Times Publishing Company’s determination as to entrant eligibility is final and binding. The use of any scheme, program or device to automate entry is prohibited. Any attempt by any entrant to tamper with or undermine the legitimate operation of the Contest will, in the Sponsor’s sole discretion, result in disqualification. Decisions of the Sponsor are final and binding.

Only one entry/vote per person, per band, per day is permitted. A mobile user may vote for multiple bands in the same day but can not vote multiple times for the same band in the same day.

The odds of winning depend on the number of eligible entries received.

The Times Publishing Company is not responsible for lost, late, misdirected, damaged, illegible, or any electronic malfunction. Sponsor is not responsible for any other problems or errors in modes of transmission of entries.

The deadline for receiving entries is Sunday, May 11, 2008 at 11 p.m. EST.

All entries become the property of the Times Publishing Company. Each Entrant acknowledges and agrees that Sponsors may use information submitted to contact Entrant and/or to offer Sponsors’ products or services.

PRIZES
The following Contest prizes will be awarded: There will be one (1) winner who will receive 2 (two) tickets to The Cure concert on June 11 (each ticket is valued at $65) and 2 (two) tickets to the Tom Petty concert on July 16 (each ticket is valued at $150) plus a two-night stay at the InterContinental Tampa and dinner for two at Shula's Restaurant (valued at $800). Total prize package is valued at $1,230. The prize is provided by the St. Pete Times Forum and the InterContinental Tampa.

No alternative prize, cash or other substitution is permitted except that in the event of prize unavailability, Sponsor reserves the right to substitute a prize or prizes of equal or greater value. Prizes are not transferable or assignable by the Winner.

All federal, state and local taxes, fees, and surcharges, and any necessary or appropriate insurance, are the responsibility of the Winner. The Winner agrees to pay all such taxes, fees, and surcharges and is responsible for furnishing proof of insurance if and as required by law. If requested, Winner must complete a W-9 tax form provided by the Times Publishing Company prior to taking possession of the Prize.
Any transportation required for the Winner to take possession of the Prize is the Winner’s responsibility and will not be furnished by the Sponsor. Winner must agree to hold the Sponsor harmless from any and all liability for damages or losses of any nature incurred in connection with use of the Prize, including transit to and from any destination in connection with the Prize.

NOTIFICATION OF WINNER
The Winners will be selected and contacted by Tuesday, May 13, 2008 at 9 a.m. in a random drawing. Winners will be notified by text message. If the Winner does not respond to the notification within forty-eight hours, or the Winner does not meet all eligibility requirements including signing the Affidavit and Release referred to below, an alternate winner will be selected by random drawing. Winner must produce adequate proof of identity, such as a valid driver license or photo I.D. card, in order to take possession of the Prize.

AFFIDAVIT AND RELEASE
The Winner will be required to sign and return an Affidavit of Eligibility and General Release, which includes an affirmation of eligibility, a release and waiver of legal claims, and a consent to publicity. Failure to complete and sign the Affidavit of Eligibility and General Release will result in forfeiture of the prize and its award to another winner chosen by random drawing.

ADDITIONAL TERMS AND CONDITIONS
All federal, state, and local laws and regulations apply. Void where prohibited by law.
By entering the Contest, the entrant, for him/herself and for his/her heirs, executors, administrators, assigns and anyone else claiming by or through him/her, waives, covenants not to sue and fully releases and forever discharges any and all rights, claims or causes of action whatsoever that he/she may have against Sponsor arising directly or indirectly out of entrant’s participation in the Contest. For purposes of this waiver and release, “Sponsor” includes Times Publishing Company and its parents, subsidiaries, affiliates, officers, directors, agents and employees. This waiver and release covers, without limitation, any damage, liability, cost, attorneys’ fees and expenses whatsoever, whether known or unknown and whether foreseeable or not.

Sponsor reserves the right to make changes in the rules of the contest, including the substitution of a prize of equivalent value, which will become effective upon announcement.

Sponsor is not responsible for typographical or other errors in printing, the offering, or the administration of the contest or in the announcement of the prize.

The Sponsor of the Contest is Times Publishing Company, 490 First Avenue South, St. Petersburg FL 33701. Copies of the written contest rules are available in the Classified section of tbt* Tampa Bay Times or will be sent by mail request if a self-addressed stamped envelope accompanies request.
